1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Noogservers website and game server hosting services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 16 years old, or the age of digital consent in your country, to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorised use.

3. The Service

We provide hosting that lets you deploy and manage game servers. We may add, change, or remove features over time. Some games, mods, and configurations may have their own licences and terms that you are responsible for complying with.

4. Acceptable use

You agree not to use the Service to:

• Break any applicable law or infringe anyone's rights, including intellectual property.
• Host or distribute malware, or launch attacks against any network or system.
• Send spam or engage in fraud, phishing, or other deceptive activity.
• Host content that is unlawful, or that we are legally required to remove.
• Attempt to gain unauthorised access to the Service or other users' data.
• Resell or abuse resources in a way that degrades the Service for others.

5. Your content

You retain ownership of the content you upload or generate on your servers. You are solely responsible for that content and for having the rights to use it. You grant us the limited rights needed to store and process it in order to operate the Service.

6. Fees, billing, and renewals

Paid plans are billed in advance on a recurring basis at the price shown when you subscribe. Unless you cancel before the end of a billing period, subscriptions renew automatically and your payment method is charged for the next period. You are responsible for any applicable taxes.

You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

48-hour money-back guarantee. If a new paid subscription is not the right fit, you can request a full refund within 48 hours of the initial purchase by contacting support. Refunds are returned to the original payment method. The guarantee applies to a first-time purchase of a plan, not to renewals, and once per customer, period — not once per plan. Outside that window, and except where required by law, payments are non-refundable.

If we cannot provision a server you have paid for, we refund that payment automatically — you do not need to ask. Nothing in this section limits any statutory cancellation, withdrawal, or refund rights you have as a consumer.

What happens when you delete a server. Deleting a server stops its billing immediately and shuts the server down straight away. Its files — your world, saves, configuration and any backups — are kept for 48 hours, matching the guarantee window above, and are then permanently destroyed. After that they cannot be recovered, by you or by us. A server we could not finish setting up holds no files of yours, so nothing is retained for it.

7. Suspension and termination

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that harms us or others. You may close your account at any time. On termination, your right to use the Service ends and we may delete your data as described in our Privacy Policy.

8. Service availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may perform maintenance and occasionally suspend parts of the Service. Any specific uptime commitments, if offered, will be set out separately.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. This does not affect any statutory rights you have as a consumer.

10. Limitation of liability

To the fullest extent permitted by law, Noogservers will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability arising from the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold Noogservers harmless from claims and costs arising out of your content, your use of the Service, or your breach of these Terms.

12. Governing law

These Terms are governed by French law, without regard to conflict-of-law rules, and subject to any mandatory consumer protections in your country of residence.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
